You get a f iancé(e) Visa in order to come to the US and get married within 90 days . In order to get a spouse Visa, you need to be already married and for the non-US spouse to live abroad. Q: How much time does the process take?

Unfortunately, US immigration procedures take a lot of months, or even years. There is no way to know how much time your procedure will take, it depends on the case, how well documented is your case and how much workload USCIS has.

Q: Do cohabitation agreements count as marriage?

No, cohabitation agreements are not the same as marriage and do not give any legal grounds for spouse or fiancé(e) VISA. Although, they can be used as proof for an established relationship.

Q: Do I have to get married in the US?

Not necessarily. You can get married in another country and then start the process of the spouse VISA. Just keep in mind that in the meantime the non-US will wait in their country until the process is completed.
